Terms of Service

1. About these terms

These terms are an agreement between you and Borna Safai ("I", "me"), the individual in Quebec, Canada who builds and runs Tend. They cover Tend's website at tendapp.ca, its web app and its apps (together, "Tend"). By using Tend, you agree to these terms and to the Privacy Policy, which explains how your information is handled.

2. Your account

You sign in to Tend with a Google account. Keep that account secure: anything done while you're signed in is treated as done by you. You must be at least 14 years old to use Tend.

3. Your content

The tasks, notes and other information you put in Tend ("your content") remain yours. You give me only the permission needed to store, sync and show your content to you, and to keep Tend running, for as long as your content is in Tend. I don't claim any other rights to it.

You're responsible for your content. Don't put anything in Tend that you don't have the right to store.

4. Acceptable use

Please don't:

• use Tend for anything illegal;
• try to get into other people's accounts or data, or into parts of Tend you're not meant to reach;
• interfere with Tend's operation, overload it, or probe it for weaknesses without permission (if you find a security problem, please email me);
• use automated means to access Tend other than through its own apps.

If someone breaks these rules, I may suspend or close their account. Except in urgent or serious cases, I'll warn them first.

5. The service

Tend is free. It's a personal project, and I'll do my best to keep it running well, but I can't promise it will always be available, free of bugs, or never lose data. Keep your own copy of anything you can't afford to lose. I may change, add or remove features.

If I decide to shut Tend down, I'll email you at least 30 days before, so you can move your tasks elsewhere.

6. Ending your use

You can stop using Tend at any time, and delete your account and everything in it in Settings → Account → Delete account.

7. Tend itself

Tend's name, design and code belong to me, apart from the open-source components listed in Settings → About → Open-source licenses, which come under their own licences. These terms let you use Tend. They don't give you any other rights to it.

8. Warranties and liability

As far as the law allows, Tend is provided "as is" and "as available", without any warranty beyond those the law guarantees. In particular, Tend doesn't guarantee that you'll be reminded of every task in time. Don't rely on it alone for anything where a missed reminder could cause harm.

As far as the law allows, I'm not responsible for indirect losses, or for losses caused by events outside my reasonable control. This doesn't limit liability for harm caused intentionally or through gross fault, or for bodily or moral injury caused to you.

If you're a consumer in Quebec, or elsewhere where consumer law gives you rights that a contract can't take away, nothing in these terms limits those rights. That includes your rights under Quebec's Consumer Protection Act and Civil Code.

9. Changes to these terms

I may update these terms. The date at the top of this page shows when they last changed. For a change that matters, I'll email the address on your account at least 30 days before it takes effect, with the new wording and what it replaces. If you don't agree, you can stop using Tend and delete your account. Continuing to use Tend after that means you accept the new terms.

10. Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. If you're a consumer, you keep the protection of the laws where you live, and you can bring a claim in the courts of the place where you live.
